Food Service Drug Testing
There have been notable challenges lately in recruiting new food service employees.  The pre-employment drug test seems to be a major stumbling block.  Generally the food service industry does not drug test, and when you are in a market with a lot of restaurant/bar competition, it can be difficult to recruit food service employees.   Has any consideration been given to not disqualifying applicants if they tested positive for Marijuana at a pre-hire drug screen? (Given that testing positive for other illegal substances would still disqualify an applicant for employment.)  Has any conversation on this subject occurred at your community?

We just discussed this last week and decided to hold off until marijuana becomes legal in NC, if it ever does.

We require drug screens for all employees. Our dining is contracted, but due to regulations regarding hiring, we require them to drug screen as well for pre employment.

We have briefly touched on this subject of removing marijuana from what disqualifies applicants from employment. However, nothing has really come from it at this point.

We have had conversations. This is an area currently we are not desiring to “lead the pack” with this issue. We are still drug testing, still is illegal in NC, feel we need to be consistent across all positions and currently not have trouble filling open positions. Also potential workers comp issue if under the influence at time of accident (same as with alcohol).

Having said this – we know this is an issue that will evolve over time and we are open to that evolution (just not on the cutting edge).

We are also considering the same—checking in with worker’s comp carrier and legal team prior to proceeding further. Given the social acceptability and prevalence of marijuana use, we are seeking to either reduce or eliminate the screening threshold for just marijuana.

We had looked into this same idea of not requiring the pre-hire drug tests for specific positions, like those in the dining services area. We consulted with an attorney that communicated to us that since we receive federal funds by accepting Medicare payments, we are required to do pre-hire drug tests for all individuals that work at least in the health care settings. We determined that we did not want to differentiate between IL and the rest of our staff, so we have kept the requirement in place. We felt that was the best decision since we get lots of transfers for various areas and it is best to have the same requirements for all.

Not until it (marijuana) becomes legal in North Carolina. I don’t see how we can allow this if we don’t for others. We are struggling with the same issues and will have to increase pay to steal from our competitors.

We are holding the line and requiring a drug free workplace.
